Terms of Service

Welcome to Athletech! These Terms of Service ("Terms") govern your access to and use of the Athletech platform and our applications, including Baseball AI, Softball AI, and any other Athletech apps, websites, and services (collectively, the "Service"). The Service is provided by Athletic Technologies Inc. ("Athletech," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility and Accounts

• You must be at least 13 years old to create an account and use the Service.
• If you are under the age of majority in your jurisdiction, you may only use the Service under the supervision of, and with the consent of, a parent or legal guardian.
• You agree to provide accurate registration information and to keep it current.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Subscriptions, Billing, and Cancellation

The Service offers a free tier with a limited number of uploads, as well as optional auto-renewable subscriptions that unlock additional features.

• Billing: Subscriptions are purchased and billed through the app store from which you download the app (such as the Apple App Store or Google Play). Payment is charged at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew for the same period unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Managing and Canceling: You can manage or cancel your subscription at any time in your app store account settings. Deleting the app does not cancel your subscription.
• Pricing: Current prices are shown in the app at the time of purchase and may change with notice as permitted by the applicable app store.
• Refunds: Purchases are handled by the applicable app store. Refund requests are subject to that app store's policies, and we do not directly process refunds for app store purchases.
• App Store Terms: Your subscription is also subject to any standard end user license agreement (EULA) required by the app store through which you obtained the app, such as Apple's Licensed Application End User License Agreement.

3. Your Content and License

• Ownership: You retain ownership of the swing, training, and other videos and content you upload ("User Content").
• License to Operate the Service: By uploading User Content, you grant Athletech a non-exclusive, worldwide license to host, store, process, and analyze that content in order to provide, maintain, and improve the Service, including generating AI feedback.
• Promotional Use: We will not use your uploaded videos or testimonials in promotional settings (such as marketing materials or pitch decks) without your explicit, separate consent. You may withdraw any granted consent at any time by contacting support@athletech.co.
• Prohibited Content: Do not upload content that is illegal, infringing, offensive, or that you do not have the right to share.

4. AI Feedback Disclaimer

Feedback, analysis, and recommendations generated by the Service are for informational and training purposes only. AI-generated results may contain errors and are not a substitute for professional coaching or instruction. We do not guarantee any particular athletic outcome, improvement, or result.

5. Health, Safety, and Assumption of Risk

The Service involves physical activity and athletic training. You should consult a qualified physician or professional before beginning any training program. You are solely responsible for exercising within your physical limits and using proper technique and equipment. By using the Service, you acknowledge and accept the inherent risks of physical activity and agree that Athletech is not responsible for any injury, harm, or damage arising from your participation in training or reliance on any feedback.

6. Acceptable Use

You agree not to misuse the Service, including by attempting to disrupt, reverse engineer, or gain unauthorized access to the Service; uploading harmful code; or using the Service in violation of any applicable law.

7. Intellectual Property

The Service, including the Athletech platform, software, models, designs, logos, and the Athletech, Baseball AI, and Softball AI trademarks and brand names, is owned by Athletic Technologies Inc. and protected by intellectual property laws. Except for the rights expressly granted to you, no rights are transferred to you.

8. Children's Privacy

Athletech does not knowingly collect personal information from children under 13. If you upload videos of, or create an account for, a child under 13, you confirm that you are the child's parent or legal guardian and consent to the data collection and processing described in our Privacy Policy. You may request deletion of a child's data at any time by contacting support@athletech.co.

9. Termination

You may stop using the Service and delete your account at any time from within the app's settings. We may suspend or terminate your access to the Service if you violate these Terms or use the Service in a way that could cause harm or legal liability. Sections that by their nature should survive termination (including content licenses, disclaimers, and limitations of liability) will continue to apply.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Athletech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars ($50).

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

14. Third-Party Marketplace Acknowledgment

You acknowledge that these Terms are between you and Athletic Technologies Inc., not with the software marketplace provider through which you obtained the app (such as Apple or Google). The marketplace provider is not responsible for the Service or its content. To the extent you obtained the app through the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
